The following terms of service (these "Terms of Service"), govern your access to and use of the BigTicket website, including any content, functionality and services offered on or through www.BigTicket.world (the "Site") by ORACLE TRADING COMPANY (PTY) LTD (2019/559166/07) of (Unit 306 Tarpe Diem, 11th Avenue Melkbos Strand, South Africa) trading as BigTicket.World and, with respect to payment processing services, for payments made from anywhere else. ORACLE TRADING COMPANY (PTY) LTD (2019/559166/07) and are collectively referred hereto as "BigTicket" "BigTicket.World" "we" or "us".
Please read the Terms of Service carefully before you start to use the Site.
By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service, BigTicket Refunds Policy, found here (“Refunds Policy”), and our Privacy Policy, found here, each of which is incorporated herein by reference.

This Site is offered and available to users who are 13 years of age or older. If you are under 13 you may not use this Site or the BigTicket services. By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.
Our Customer Support team is available 24/7 if you have any questions regarding the Site or Terms of Service. Contacting our Customer Support team can be performed by submitting a request here.
The original language of these Terms of Service, as well as all other texts throughout the Site, is English. BigTicket makes available this translation for convenience only. In case of conflicts between the original English version and any translation, the English version shall prevail.
Buyers are users who purchase services on BigTicket.
Business Account is a collaborative Buyer account, created via BigTicket Business, as detailed on BigTicket Business Terms of Service (available here).
Business Account Team Member or Team Member is any user that is invited or uses a Business Account.
Custom Offers are exclusive job tickets that a Seller can create in response to specific requirements of a Buyer.
Custom Orders are requests made by a Buyer to receive a Custom Offer from a Seller.
Job Ticket Extras are additional services offered on top of the Seller’s Job Ticket for an additional price defined by the Seller.
Job Ticket Packages allow Sellers to offer services in different formats and prices. Packages can include upgrades, which lets Sellers price their service for a basic price of over R5.
Job Ticket Page is where the Seller can describe their Job Ticket and the Job Ticket’s terms, and the Buyer can purchase the Job Ticket and create an order.
Job Ticket / Job Tickets are services offered on BigTicket.
Order Page is where Buyers and Sellers communicate with each other in connection with an ordered Job Ticket.
Orders are the formal agreement between a Buyer and Seller after a purchase was made from the Seller’s Job Ticket Page.
Sellers are users who offer and perform services through Job Tickets or through the Logo Maker on BigTicket.
Only registered users may buy and sell on BigTicket. Registration is free.
Job Tickets on BigTicket may be offered at a base starting price of R5. Some Job Tickets are offered at a base price of more than R5 as determined by the Seller.
Buyers pay BigTicket in advance to create an order (see Refunds Policy).
Orders are purchased through the Order button found on a Seller’s Job Ticket page or through a Custom Offer.

Sellers must fulfill their orders, and may not cancel orders on a regular basis or without cause. Cancelling orders will affect Sellers’ reputation and status.
Sellers gain account statuses (Levels) based on their performance and reputation. Advanced levels provide their owners with benefits, including offering services for higher prices through Job Ticket Extras, or selling their Job Ticket in multiples.
Users may not offer or accept payments using any method other than placing an order through BigTicket.world.
When purchasing a Job Ticket, Buyers are granted all rights for the delivered work, unless otherwise specified by the Seller on their Job Ticket page. Note: some Job Tickets charge additional payments (through Job Ticket Extras) for Commercial Use License. See our “Ownership” and “Commercial Use License” sections below for more information.
BigTicket retains the right to use all published delivered works for BigTicket marketing and promotion purposes.
We care about your privacy. You can read our Privacy Policy here. The Privacy Policy is a part of these Terms of Service and incorporated herein by reference.
Users undertake to comply with BigTicket’s Community Standards, which are a set of behavior rules and guidelines, applicable to the BigTicket community and marketplace in addition to these Terms of Service, as updated from time to time.
Sellers create Job Tickets on BigTicket to allow Buyers to purchase their services.
Sellers may also offer Custom Offers to Buyers in addition to their Job Tickets.
Each Job Ticket you sell and successfully complete, accredits your account with a net revenue of 99% of the purchase amount.
BigTicket accredits Sellers once an order is completed. See our "Orders" section below for a definition of a completed order.

Sellers may promote their Job Tickets or any BigTicket content via the Google Ads platform.
The Seller's rating is calculated based on the order reviews posted by Buyers or Business Account Team Members. High ratings allow Sellers to obtain advanced Seller levels (see Levels below). In certain cases, exceedingly low ratings may lead to the suspension of the Seller’s account.
For security concerns, BigTicket may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple BigTicket accounts to a single withdrawal provider.
Sellers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.
Sellers are allowed to post a select amount of active Job Tickets based on their Level status.

Job Tickets created on BigTicket are User Generated Content.
Job Tickets and/or users may be removed by BigTicket from the Site for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials:
Illegal or Fraudulent services
Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service reported through our Intellectual Property Claims Policy found here
Adult oriented services, Pornographic, Inappropriate/Obscene
Intentional copies of Job Tickets
Spam, nonsense, or violent or deceptive Job Tickets
Job Tickets misleading to Buyers or others
Reselling of regulated goods
Offering to prepare academic works on behalf of Buyers
Services that extend beyond 30 days of service duration
Exceedingly low quality Job Tickets
Promoting BigTicket and/or BigTicket Job Tickets through activities that are prohibited by any laws, regulations, and/or third parties' terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.
Job Tickets that are removed for violations mentioned above, may result in the suspension of the Seller’s account.
Job Tickets that are removed for violations are not eligible to be restored or edited.
Job Tickets may be removed from our Search feature due to poor performance and/or user misconduct.
Job Tickets may include pre-approved website URLs contained within the Job Ticket description and requirements box. Job Tickets containing websites promoting content, which violates BigTicket’s Terms of Service and/or our Community Standards, will be removed.
Job Tickets are required to have an appropriate Job Ticket image related to the service offered. An option to upload two additional Job Ticket images are available to all Sellers. Sellers must deliver the same quality of service as shown on their Job Ticket images. Recurring deliveries that don’t match the quality shown on the Job Ticket images may lead to the Seller’s account losing Seller status or becoming permanently disabled.
Job Tickets may contain an approved Job Ticket Video uploaded through the Job Ticket management tools available on BigTicket.
Statements on the Job Ticket Page that undermine or circumvent these Terms of Service is prohibited.
Eligible Job Tickets in select Categories may set up Job Ticket Packages to offer their services in structured formats with multiple price points for the selected Job Ticket.
Certain categories are available only to Pro Sellers to create Job Tickets. If you are not a Pro Seller, creating a Job Ticket for services available to Pro only may result in removal of your Job Ticket.
Job Ticket Extras are additional services offered on top of the Seller’s Job Ticket for an additional price defined by the Seller.
Job Ticket Extras may be removed for violations of our Terms of Service and/or our Community Standards. For specific terms, please see the Job Tickets section above for a list of services that violate our Terms of Service. Job Tickets are subject to be removed due to violations found in Job Ticket Extras.
The amount of Job Ticket Extras, which can be offered, and the price for each Job Ticket Extra, is based on your Seller Level. More information surrounding your accounts eligibility for Job Ticket Extras can be found here.
Services offered through Job Ticket Extras must be related to the base service and part of the deliverables on the Order.
Job Ticket Extras may cover different categories of services that are components to a higher quality delivered service.
In such cases and where possible we will credit your BigTicket account, or refund the full monetary value of the service, subject to the below terms.
BigTicket.world reserves the right to assess and credit or refund clients on a discretionary case by case basis.
This is acknowledged pre-purchase of “BigTicket.world” services that are in some cases services are reliant on the delivery of third party suppliers (where BigTicket.world simply serves and an intermediary service to a third party supplier).
For all refund queries please direct enquiries to hello [@] BigTicket.world where a ticket escalation ticket may be logged.
In such cases where a third party service provider has failed to deliver or short delivered on an order BigTicket.world would reserve the right to review the case and source a new supplier to deliver the requested service before refund or credit is issued.
Transaction charges levied between suppliers in the operation of some web services may carry transaction costs and “handling fees” or in most cases these transactions are embedded into the product sales price and are not refundable.
BigTicket.world makes no guarantee whatsoever on the outputs of services delivered as part of service offering. Reporting on services provided is limited to the output delivery and NOT it’s effectiveness in the market place where there are many variables beyond our control. Goods and services are delivered as stated and not subject to refund or credit without management approval.
Vouchers and coupons are not eligible for refund or credit under any circumstances. There are two methods on BigTicket.world used to issue “promotional” vouchers and coupons. These funds are virtual and not representative of monetary value.
Credit balance refunds are refundable in circumstances whereby a client wishes to close their account with BigTicket.world in such cases please email hello [@] BigTicket.world with an account refund and cancellation request. Funds are transferred back to assigned bank accounts from date of our bi-monthly supplier payment cycles and refunds are NOT issued immediately. Please NOTE: ID verification as well as other precautionary measures will need to be requested and furnished in order to validate the account holders payment details.
Cancellation on the part of BigTicket.world, 3rd Party supplier or the account holder will result in the full purchase price being refunded to the account holders credit balance on BigTicket.world Cancellation is no indicative of due monetary refund and is usually automatic.
By default BigTicket.world reserves the right to hold credit funds in good faith for service delivery on behalf of account holders. In the event that there is a dispute in relation to a service provided from this platform BigTicket.world limitation of liability extends only to the value of the services willingly and electively purchased via the BigTicket.world platform.
In good faith we provide a range of marketing and promotional services. Account holders that abuse our services or attempt to exploit BigTicket.world systems or use BigTicket.world systems to exploit services are subject to having immediate account closure without refund in reserve of all due rights.
These rights include the
Circumvention of BigTicket.world payment platforms to solicit suppliers in our network (strictly prohibited).
Bring repetitional harm to the BigTicket.world brand or service offering.
Any direct violation of the terms agreement on registering with BigTicket.world
BigTicket.world does not sell, rent or give any identifiable personal information regarding its members to any third party unless the member has subscribed to such services on his/her own. Any information that you give to us is held with the utmost care and security.
BigTicket.world will work with our partners, such as advertising agencies, content providers, to bring you relevant information that pertains to your interest categories, and thus some of your information may be shared with such parties. However all companies that we work with will also be bound by our privacy statement.
You will never receive any unwanted email or postal mail as a result of information you have given to BigTicket.world. And you can opt-out or unsubscribe to any lists or announcement categories at any time by following the procedures set forth by BigTicket.world.
When you register as a member at BigTicket.world, you must submit your name, email address and your website information so that we can properly set up your account and send you the relevant information that you have requested or subscribed to.
BigTicket.world will not collect any personal information about individuals except when specifically and knowingly provided by such individuals. Examples of such information are name, postal address and email address. BigTicket.world may share non-personal aggregate, or summary, information regarding its customers with partners or other third parties, but BigTicket.world does not sell or share any information at the individual customer level unless the individual customer has subscribed to receiving such information.
By registering as a member at BigTicket.world, you agree to accept this privacy policy and are aware that our policy may change at any time. This policy will always be available to users on this page for members to read.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymised string created from your e-mail address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Please read these Payment Terms carefully before making or receiving payments through the Site. By making or receiving payments through the Site, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Payment Terms. These Terms are supplemental to BigTicket’s general terms of service (the “Terms of Service”)
Key Terms
Capitalized terms used but not defined herein shall have the respective meanings given to them in the Terms of Service. BigTicket Balance is the aggregated amount of your Revenue as a Seller and/or returned payments from canceled orders as a Buyer and/or your BigTicket Business Balance (as defined in the BigTicket Business Terms). Payment Services Provider(s) are service providers that provide payment services to Buyers and Sellers in connection with the BigTicket platform, including with respect to collection of funds from Buyers in connection with purchases, remittance and withdrawal of funds to Sellers, currency exchange services in connection with payments and withdrawals in local currencies, and the holding of funds in connection with BigTicket Balances. Revenue is the money that Sellers earn from completed orders and can either withdraw or use to purchase on BigTicket, subject to these Terms.
Receiving Payments
General
Each Job Ticket you sell and successfully complete, accredits your account with a net revenue of 80% of the purchase amount.
Each Logo Design you sell through the Logo Maker accredits your account with a net revenue of 80% of the Basic Logo Package price and 20% of the margin on top of the Basic Logo Package price.
BigTicket accredits Sellers once an order is completed. See the "Orders” section in the Terms of Service for a definition of a completed order.
If an order is canceled (for any reason), the funds paid will be returned to the Buyer’s BigTicket Balance.
Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply to them depending on residency, location or the billing information they provide in their account settings. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The price shown on the Job Ticket page or on the Logo Maker order page is inclusive of all such taxes and charges that may apply to the Sellers.
Appointment as Limited Payment Collection Agent: Seller hereby appoints BigTicket as Seller’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Buyer, and remitting those payments to Seller. Seller agrees that payment from Buyer to BigTicket shall be considered the same as a made directly to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by BigTicket (or its Payment Services Provider, as applicable), and BigTicket (via its Payment Services Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. In the event that BigTicket (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against BigTicket and not the Buyer directly. Seller agrees that BigTicket may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices including, but not limited to, receipts provided to Buyers that BigTicket may deem necessary or prudent.
BigTicket partners with Payment Services Providers for purposes of collecting payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with BigTicket Balances. All payments services in connection with the withdrawal of funds on the BigTicket platform are performed by BigTicket’s Payment Services Providers.
Withdrawing Revenues
To withdraw your revenue, you must have an account with at least one of BigTicket's Payment Service Providers for the withdrawal methods listed below. All funds eligible for Withdrawal will be held on your behalf at an account with BigTicket’s Payment Services Provider. All payment services, including withdrawal services, will be provided by BigTicket’s Payment Services Provider.
Your BigTicket profile can be associated with only one account from each BigTicket withdrawal method. A Payment Service Provider withdrawal account can be associated with only one BigTicket profile.
Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete. Top Rated Sellers are eligible to withdraw revenue following a safety clearance period of 7 days after the order is marked as complete. For BigTicket Studio Members, the safety clearance period depends on the Studio Lead’s Level Status or classification (Level 1, Top Rated, Pro, etc.).
Sellers may withdraw their revenues using one of BigTicket’s withdrawal options (see Withdrawal Section below regarding payment terms). To withdraw your available revenue, you must click on the designated withdrawal provider to initiate the withdrawal process.
For security concerns, BigTicket may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple BigTicket accounts to a single withdrawal provider.
Withdrawals can only be made in the amount available to you.
Withdrawal fees vary depending on the withdrawal method.
Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun.
In certain cases, Sellers may withdraw Revenues in several different currencies. All currency exchange services in connection with such withdrawals are performed by BigTicket’s Payment Services Providers. Your BigTicket Balance is always derived from its US$ value and, therefore, the local currency amount of your BigTicket Balance may change daily in accordance with exchange rate fluctuations and also includes conversion fees. Sellers always have the option to withdraw Revenues in US$.
Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to BigTicket's approval.

Direct Deposit (ACH) - $1 per transfer*. For more information, see Pricing and Fees. Available only in the US.

Purchasing
General
Buyers pay BigTicket to create an order from a Seller’s Job Ticket page or Custom Offer, using the Order Now button or through the Logo Maker. BigTicket partners with Payment Services Providers for purposes of collecting all payments from Buyers, transferring such payments from Buyers to Sellers, and holding funds in connection with BigTicket Balances. All payments services in connection with the collection of funds on the BigTicket platform are performed by BigTicket’s Payment Services Providers.
BigTicket serves as Seller’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Buyer, and remitting those payments to Seller. Buyer’s payment obligation to Seller will be satisfied upon receipt of payment by BigTicket (or its Payment Services Provider, as applicable), and BigTicket (via its Payment Service Provider, as applicable) is responsible for remitting the funds to the Seller in the manner described in these Payment Terms. In the event that BigTicket (via Payment Services Provider) does not remit any such amounts to Seller, the Seller will have recourse only against BigTicket and not the Buyer directly.
In most locations, purchases on BigTicket can be made by using one of the following payment methods: Credit Card, PayPal, BigTicket Credits or existing BigTicket Balance. Additional payment methods may apply in certain locations.
Service fees are added at the time of purchase where you can review and accept the total amount requested to pay. These fees cover administrative fees. As of May 2018, the current fees assessed to the total purchase amount are $2 on purchases up to $40 and 5% on purchases above $40.
Your existing BigTicket Balance will be automatically applied to your next purchase.
You may not offer Sellers to pay, or make payment using any method other than through the BigTicket.world site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here.
To protect against fraud, unauthorized transactions (such as money laundering), claims, or other liabilities, payment information in connection with withdrawals is collected by either BigTicket or BigTicket’s Payment Services Providers. Payment Services Providers may also collect such other information as necessary for the purpose of processing withdrawal payments. BigTicket is not exposed to the payment information provided to Payment Services Providers, and this information is subject to the privacy policy applicable to the Payment Service Provider. Please see our Privacy Policy for more information here.
By using any payment method and/or providing payment details for making purchases on BigTicket, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on BigTicket; and (d) such actions do not violate any applicable law.
Purchasing through BigTicket Logo Maker
All Logo Designs have a fixed US$ price and can be purchased either in the “Basic Logo Package” or in additional packages as indicated in the Logo Design order page.
Before completing an order, you will be able to preview a watermarked version of the Logo Design embedded with your brand name, and to further modify the Logo Design using the editing tools. Once payment has been made, orders of Logo Designs may not be canceled.
In addition to the Logo Design package you choose, you can purchase redesign services from the Seller who created the Logo Design. The price of such redesign services is determined by the Seller and a service fee will be charged solely for the additional redesign services. For cancellations of logo redesign services, please refer to the “Disputes and Cancellations” section below.
Local Currencies
You can pay on BigTicket in several different currencies. Unless stated otherwise, you will be charged in the currency displayed on the payment page. All currency exchange services in connection with payments in local currencies are performed by BigTicket’s Payment Services Providers. In certain cases, however, when certain currencies are not supported by certain payment methods, you will be charged in US$ even if the price is displayed in another currency. In any event, the actual charged amount (in the actual payment currency) will be clearly disclosed to you before you complete the payment.
Note that all prices on BigTicket are derived always from their original US$ price and, therefore, non-US$ currency prices may change daily in accordance with exchange rate fluctuations and may also include conversion fees. Buyers always have the option to pay in US$ by changing their selected displayed currency.
If you paid for an Order in a currency other than US$ and your Order was later canceled for any reason, the amount returned to your BigTicket Balance would be based on the exchange rate as of the date of cancellation. Therefore, the returned amount may vary from the paid amount in local currency terms, while always maintaining the same US$ value.
Your BigTicket Balance is always valued in US$, even if it is displayed in a non-US$ currency. Therefore, should you choose to view your BigTicket Balance in any currency other than US$, it may change daily in accordance with exchange rate fluctuations, while always maintaining the same US$ value. Users always have the option to view their BigTicket Balance in US$ by changing their selected displayed currency.
Taxes
Buyers may be charged with indirect taxes (such as Sales Tax, VAT or GST) depending on the billing information provided by the Buyer and the applicable laws of their billing location, and, if no billing information was provided, depending on their location and the applicable laws of such location. All indirect taxes are in addition to the price shown on the site, and, in any event, any such taxes will always be displayed to the Buyer before payment.
Buyers agree that they are responsible to comply with all tax requirements applicable to them, including but not limited to any obligation to deduct or withhold taxes. It is hereby clarified that all prices and fees that appear on the Site are the net amounts that will be paid following any direct or indirect taxes, levy, withholding tax, and/or deductions.
BigTicket Credits
In certain instances, BigTicket may offer you credits (“BigTicket Credits” or “Credits”), either for promotional purposes or otherwise, to be used for purchasing Job Tickets and/or other services offered on the Site. Your available Credit balance will appear in your account. Your valid BigTicket Credits will be automatically applied to your next purchase and can be viewed in your order summary after you place the order. Unless stated otherwise, BigTicket Credits expire following three months from their receipt. BigTicket Credits serve only as an incentive to use BigTicket, and, therefore, are not redeemable for cash, have no cash value and are nonrefundable. Once used, BigTicket Credits may not be returned to your account even if your Order gets canceled. BigTicket Credits may be subject to additional conditions and restrictions as will be disclosed to You upon receipt of the Credits. Credits may be voided in the event of fraud, misuse, or violation of these Terms. BigTicket reserves the right to modify or cancel the BigTicket Credits program at any time. If you or BigTicket deactivate or suspend your BigTicket account, any unused BigTicket Credits in your account will be forfeited.
Disputes and Cancellations
We encourage our Buyers and Sellers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site, users can contact BigTicket's Customer Support department for assistance here.
Basics
Order cancellations can be performed on BigTicket, when eligible, by Customer Support or through the Resolution Center per order.
Filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation of these Payment Terms. Doing so may get your account temporarily or permanently disabled. Note: Once you have filed a dispute with your payment provider, the funds will be ineligible for a refund due to our obligations towards the payment provider.
In the event that you encounter an issue related to the service provided in an order, you are encouraged to use the Site's dispute resolution tools to attempt to resolve the matter.
BigTicket, through its Payment Services Provider, reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Site.
All transfer and assignment of intellectual property to the Buyer shall be subject to full payment and the delivery may not be used if payment is canceled for any reason.
If an order is canceled (for any reason), the funds paid will be returned to the Buyer’s BigTicket Balance.
Revisions to deliveries can be performed by Sellers based on the Seller’s Job Ticket and customer care. Sellers may determine the amount of revisions they wish to offer, including no revisions.
Requests for revisions can be performed through the Order Page while the order is marked as Delivered.
Requesting to gain more services from Sellers beyond the agreed requirements by using the Request Revisions button is not allowed.
Order Cancellations
BigTicket encourages Buyers and Sellers to resolve service disputes mutually using the Resolution Center.
This Policy sets out the dispute process followed when a Buyer and Seller who have used any of our Payment systems elect to use to the Dispute Resolution process to resolve a dispute between them.
Both parties of the Dispute case can elect to have their dispute arbitrated by BigTicket’s internal Dispute Team. The role of the Dispute Team extends to making all actions necessary to resolve the case in an impartial and evidential manner. You acknowledge that the verdict of the Dispute Team is final, binding, and irreversible.
Big Ticket Buyers
Once a dispute is opened, a Buyer is given 14 days to respond to it. Otherwise, they will automatically lose the dispute and the pending will be transferred to the Seller's account.
BigTicket Sellers
Once a dispute is opened, a Seller is given 4 days to respond to it. Otherwise, they will automatically lose the dispute and the pending will be returned to the Buyer's account.
Dispute Resolution Process
Stage 1 - Identify the issue
The complainant should select the Project and the payment or payments to be disputed. A User could contest all the Milestones related to a single project in one dispute.
After which, a description of the issue and an explanation of why the dispute is being opened should be given. From this stage until Stage 3, users are encouraged to attach any files that could support their claims.
Finally, the complainant is requested to enter the amount he or she is prepared to pay for the Project (if a Buyer) or wish to get paid for the Project (if a Seller). The amount could be between 0 and the total amount of the Payment(s) in question.
Stage 2 - Negotiation
At this stage, either party can negotiate for partial compensation, or (after a period of time) choose to have Freelancer's Dispute Team arbitrate the dispute. Both parties will have the opportunity to tell their side of the story and also negotiate terms to resolve the issue between themselves.
Only the party who originally filed for the dispute can cancel the dispute. If the issue cannot be resolved through negotiation, either party can choose to pay the Arbitration Fee to have the dispute arbitrated by the Dispute Team. The Arbitration Fee will be refunded if the dispute is either settled through mutual agreement or cancelled before reaching arbitration.
Stage 3 - Final Offers and Evidence
After one of the involved parties has paid the Arbitration Fee, the other party has 4 days to also pay the fee. Either party still has the option in this period to negotiate with the other party.
If the responding party does not pay the arbitration fee within the 4 days, the result will be in favour of the party who escalated the dispute into arbitration first.
If a solution is found before the responding party pays the fee, the party who paid the Arbitration Fee will be refunded this fee.
Stage 3 is the last stage where both Users can submit their final evidence to support their case. After Stage 3, the involved parties are no longer allowed to submit evidence. The dispute will be resolved based upon the evidence provided through the Dispute System, or that is otherwise available to the Dispute Team, such as the project description and correspondence between the parties.
Once the dispute has proceeded to Stage 4, further evidence will no longer be accepted.
Stage 4- Arbitration
At Stage 4, the Dispute Team will review all evidence and other information provided to reach a decision. Dispute verdicts are final, binding, and irreversible. The party who wins the dispute will be refunded their Arbitration Fee.
In the event that one of the parties of the Dispute has paid the Arbitration Fee, the other party will be given 4 days to pay the Arbitration Fee to move into Arbitration, and failure to do such will close the dispute by default, in favour of the party who initiated stage 4, with the arbitration fee initially paid refunded.
Requirements for Your Dispute
Should you elect to have the Dispute Team arbitrate your dispute, you agree to allow the Dispute Team to read all correspondence made on the Site and download or access, and test (if necessary), all uploaded files, programs, and websites related to the dispute for the sole purpose of having your dispute resolved.
You are encouraged to submit all the documents that would support your claims on your dispute.
Submit e-mail correspondences as screenshots or as *.eml files. If submitting screenshots, ensure that the "To", "From", and the "Date" bar is visible. E-mail correspondences sent in *.txt or *.doc or any word processing software will not be honoured. For proof of external correspondence, users should provide screenshots of their entire unedited conversation.
Online conversations should be submitted as screenshots of the conversation from the software used (Skype etc).
Provide the products, contracts, and other files relating to the project and the dispute.
BigTicket. World will retain the confidentiality of the project and the privacy of the involved users and will not release the collected information to any party unless required by law.
Fee
The fee for a dispute is $10.00 USD or 7%, whichever is greater, payable by each party. The fee will then be refunded to the winner of the dispute.
